face to face, and that he (said Gleed) did not strike him (said Smith) from behind.

Whereas, in truth and in fact, the said Robert Gleed, when he first met said G. T. Smith on the day of the difficulty with him, did not stop before him (said Smith), and did not first strike him with a stick while they were face to face, and he (said Gleed) did strike him (said Smith) from behind.

And, whereas, the statements and evidence so made and given by said Robert Gleed were material to the inquiry then and there pending, as aforesaid, before said grand jury, and whereas, the said Robert Gleed did then and there, in manner and form aforesaid, willfully, corruptly and feloniously, swear, affirm and testify falsely to material matters and things concerning the charge so preferred and then pending against him before said grand jury, and then being duly inquired of by them, therefore, the jurors aforesaid, upon their oath aforesaid, do say, that the said Robert Gleed, in said county, on the said
