The “Missionary Union Baptist Church of Columbus Mississippi,” (a corporate body authorized by law to sue and be sued by that name) as plaintiff complains of Robert Gleed summoned &c, of a plea of trespass on the case, for that whereas the said Robert Gleed on the 1st day of December AD 1870 at to wit in said County was indebted to the said plaintiff to wit in the sum of One Hundred and Eighty two dollars lawful money of the United States, for money by the said Robert Gleed before that time had and received to the use of the said plaintiff, and being so indebted he the said Robert Gleed in consideration thereof, afterwards to wit, on the same day and year aforesaid at the place aforesaid, undertook and faithfully promised the said plaintiff to pay plaintiff the said last mentioned sum of money when he the said Robert Gleed should be thereto afterwards requested.
And whereas the said Robert Gleed, afterwards to wit on the same day and year aforesaid at the place aforesaid accounted together with the said “Missionary Union Baptist Church of Columbus Mississippi,” of and concerning divers other sums of money before that time due and owing from the said Robert Gleed to the said “Missionary Union Baptist Church of Columbus Mississippi” and then being in arrear and unpaid; and upon that account he the said Robert Gleed was then and there found in arrear to said plaintiff in another large sum of money, to wit the sum of other one hundred and Eighty two dollars of like lawful money, and being so found in arrear he the said Robert Gleed in consideration thereof afterwards to wit on the same day and year aforesaid, undertook, and faithfully promised the said “Missionary Union Baptist Church of Columbus Mississippi” to pay plaintiff the last mentioned sum of money when he the said Robert Gleed should be thereto afterwards requested.
Yet the said Robert Gleed not regarding his said several promises and undertakings so by him made in his behalf as aforesaid, but contriving, and fraudulently intending, craftily and subtilly to deceive and defraud the said “Missionary Union Baptist Church of Columbus Mississippi” in this behalf, hath not as yet paid the said several sums of money, or any part thereof to the said plaintiff, though often requested so to do, but he to do this hath hitherto wholly refused, and still refuses so to do to the said plaintiff’s damages of five hundred Dollars and therefore plaintiff brings this suit &c.
