State of Mississippi vs. Robert Gleed<\/a>, 1874-1877<\/p>\n

This is a rather confusing collection of documents because two separate cases – one for Assault & Battery (3731) and one for Perjury (3800) in the A&B case – are intertwined. I’ve put them in chronological order and transcribed what I considered to be the most pertinent information. \nOctober Term, A. D., 1874<\/p>\n

The Grand Jurors of the State of Mississippi, elected, empanelled, sworn and charged to inquire for the body of the County of Lowndes \u2014 upon their oath present, that Robert Gleed \u2014 late of said County, on the 15th day of October A.D. 1874, in said County, in and upon one G. T. Smith in the peace of said State, then and there being, did make an assault. And the said Robert Gleed \u2014 with a certain deadly weapon, to-wit, a pistol \u2014 did then and there strike, shoot \u2014 and wound the said G. T. Smith \u2014 with intent him, the said G. T. Smith \u2014 then and there feloniously, willfully, and of malice aforethought to kill and murder, against the peace and dignity of the State of Mississippi.<\/p>\n

And the jurors aforesaid, upon their oath aforesaid, further present that Robt Gleed, late of said county, on the 15th day of October A.D. 1874, in said county, in and upon one G. T. Smith, in the peace of said state then and there being did make an assault. And the said Robert Gleed, with a certain stick, did then and there strike, beat, [?] and wound the said G. T. Smith, and other wrongs then and there did to the said G. T. Smith, against the peace and dignity of the state of Mississippi.<\/p>\n

Circuit Court,
\nOctober Term, 1874.<\/p>\n

The grand jurors of the State of Mississippi, elected, empanelled, sworn and charged to inquire for the body of the county of Lowndes, upon their oath present, that Robert Gleed, late of said County, on the 12th day of November, A.D. 1874, in said County, came voluntarily before the grand jury of said County, empanelled at said term, of said Court, and prior to his examination as a witness before said grand jury, as aforesaid, was duly and legally sworn by C. Hardy, who was then and there foreman of said grand jury, and as such had competent authority to administer said oath; that, after coming before said grand jury, as a witness as aforesaid, and after having been legally sworn, as aforesaid, under the sanction of such oath, the said Robert Gleed then and there gave testimony as to sundry violations of the laws of said state, and after having made certain statements in regard thereto, then and there under sanction of said oath, administered as aforesaid, proceeded to make statements and give evidence in his own behalf, in regard to a charge of assault and battery with intent to kill one G. T. Smith, which had been preferred against said Robert Gleed, before the grand jury of said County, and which the said grand jury had partially investigated, and were still considering, and which was then and there pending before them; and the said Robert Gleed, on the day and year last aforesaid, in said County, did then and there willfully, corruptly and feloniously swear falsely to material matters and things concerning the said charge so preferred, and then pending against him, before said grand jury, and then being duly inquired of by them, in substance and to the effect following, to-wit:<\/p>\n

That, when he first met said G. T. Smith on the day of the difficulty with him, he stopped before him (said Smith), and first struck him with a stick, while they were face to face, and that he (said Gleed) did not strike him (said Smith) from behind.<\/p>\n

Whereas, in truth and in fact, the said Robert Gleed, when he first met said G. T. Smith on the day of the difficulty with him, did <u>not<\/u> stop before him (said Smith), and did <u>not<\/u> first strike him with a stick while they were face to face, and he (said Gleed) <u>did strike<\/u> him (said Smith) from behind.<\/p>\n

And, whereas, the statements and evidence so made and given by said Robert Gleed were material to the inquiry then and there pending, as aforesaid, before said grand jury, and whereas, the said Robert Gleed did then and there, in manner and form aforesaid, willfully, corruptly and feloniously, swear, affirm and testify falsely to material matters and things concerning the charge so preferred and then pending against him before said grand jury, and then being duly inquired of by them, therefore, the jurors aforesaid, upon their oath aforesaid, do say, that the said Robert Gleed, in said county, on the said 12th day of November, A.D. 1874, wickedly, falsely, corruptly and feloniously, did then and there, in manner and form aforesaid, commit wicked, false, corrupt and felonious perjury, contrary to the statute in such case made and provided, and against the peace and dignity of the state of Mississippi.<\/p>\n

Whereas, at the November Term, 1874, of the Circuit Court of Lowndes County, in said State, Robert Gleed was Indicted for the crime of Assault and battery with intent to Kill, and by the Court held to answer<\/p>\n

Now, Therefore, I, A K Davis Lieut Gov Actg Governor of the State of Mississippi, by virtue of the authority vested in me by the Constitution and Laws of said State, and for divers good and sufficient reasons, me, thereto moving, do grant unto the said Robert Gleed a full pardon for said crime of Assault and battery with intent to Kill and do authorize and direct you, on receipt of these presents, to release him from confinement.<\/p>\n

In Testimony Whereof, I have hereunto set my hand and caused the Great Seal of the State of Mississippi to be affixed this 27th day of November 1874.<\/p>\n

We Command you to take the body of Robert Gleed if to be found in your County, and him safely keep, so that you have his body before the Judge of our Circuit Court, now in session, for the County of Lowndes, at the Court House in the town of Columbus, on the 4 Monday of April 1876, then and there to answer the State of Mississippi, on an Indictment found by the Grand Jurors of said State at October Term 1874 of our said Circuit Court for Assault & Battery with intent to Kill contrary to the statute in such case made and provided, and against the peace and dignity of the State of Mississippi.<\/p>\n

Bond will be required in the sum of \u2014 Dollars.<\/p>\n

Herein fail not, and have then and there this Writ.<\/p>\n

The condition of said recognizance is, that whereas, at the October term, A.D. 1874, of the circuit court of Lowndes county, a bill of indictment was found by the Grand Jury of said county against the above named Robt Gleed charging him with Assault and Battery with intent to Kill<\/p>\n

Now, if the said Robt Gleed does personally appear before the circuit court of said county, at the Court House thereof on the Fourth Monday of April A.D. 1876, to answer said charge of which he is Indicted, and shall not depart from said court, but shall remain from day to day and from term to term, until he shall be fully discharged, then this recognizance to be void.<\/p>\n

And the said Robert Gleed in his own proper person comes into court here, and having heard said indictment read, says, that the said state ought not further to prosecute the said indictment against him the said Robert Gleed; because he says, that since the finding and return of said indictment into court here to wit on the 27th day of November 1874, a pardon has been granted & issued to him for the offence in said indictment charged in words & figures following to wit:<\/p>\n
