Last Will and Testament of H. P. Scott.
Knowing that my end is near, I, H. P. Scott, being over the age of twenty-one years do publish and declare this to be my last will and testament. First, I bequeath unto my wife Nancy Scott all the money and personal property of which I may die seized and possessed, also the proceeds of all notes and claims of all kinds and description to be used, and held and enjoyed by her absolutely. Second, I will and bequeath and devise unto my said wife all the real estate of which I may die seized and possessed to be held and owned by her during the period of her natural life, the same to descend in equal parts to my sons Willis H. and Frank C. Scott, or if either of them should die before the death of my said wife then to the heir or heirs of such son. Third, I bequeath and devise unto my sons Frank C. and Willis H. Scott and my friend W. E. Mollison my claim against the Freedman’s Savings and Trust Company to be by them shared equally, whatever divident or interest may be paid out of the same. I do hereby appoint my wife, Nancy Scott, sole executrix of this my last will and testament, and direct that she be required to give no bond for the performance of her duties as such.
Signed, published and declared in the presence of Francis Green, and Mrs. Mattie Foster at Garcia or New Kansas this August 13th, 1899, and request them to sign the same as witnesses.

Issaquena County
Before me the undersigned a clerk of the chancery Court of Issaquena County personally appeared Mattie Foster who being sworn to answer such questions as might be propounded to her touching the probate of a certain instrument of writing purporting to be the last will and Testament of H. P. Scott, testified as follows.
Question: Did you know Henry P. Scott in his life time? Answer: I knew him well. Question: When did you last see him and what was his Condition? Answer: I last saw him in his last illness at his home at New Kansas in this County, he was very ill, I saw him — days before his death. Question: was he of sound and disposing mind and memory? Answer: he was. Question: Look at the instrument hereto annexed, and say whether you ever saw it before and under what Circumstances? Answer: I was present when that instrument was signed by Mr Henry P. Scott. He requested me to sign it as a witness. I did so. He also requested Mr Francis Green who was present to sign as a witness and Mr Green signed it in my presence and also in the presence of Mr Scott, the testator. Q. Did Mr Henry P. Scott sign his writing in your presence. A. He did, and also in the presence of Francis Green the other subscribing witness and we signed as witnesses, at Mr. Scott’s request and in the presence of each other. Sworn to and subscribed before me this 3rd day of October 1899 –
